I cannot make any guarantees other than to deliver the photography or coaching services purchased as described.

Design Your Destinations LLC disclaims all liability for any inaccuracy, error or incompleteness in the Content.

CONFIDENTIALITY

The Travel Consultant recognizes that anything Client shares is regarded as confidential, whether it is business or personal information. Client’s identity and ongoing consulting relationship will be kept strictly confidential. The Consultant will only release confidential information with the Client’s written permission or if required by court order and will never disclose the Client’s name as a reference without the Client’s prior written consent.

Group Sessions

Some sessions may be conducted in a group format. By signing this agreement, the Client commits to maintaining the confidentiality of all information communicated to Client by other consulting clients and by the Consultant. While both parties understand that progress is often enhanced when clients are allowed to discuss their consulting relationship with trusted colleagues and friends, the Client must in no way share information that leads to the identification of others in the group. If the Client is ever in doubt regarding what to reveal and what not to reveal, the Consultant asks that he or she err on the side of protecting the privacy of others, thereby preserving a vital and nonnegotiable element of such group interaction.

Legal Disclosure

The Client should be aware that there are certain, limited situations where confidentiality cannot and will not be maintained: (1) the physical or sexual abuse of a child will be reported to the appropriate authorities; (2) elder abuse will be reported to the appropriate authorities; (3) if it appears that Client at imminent risk to him or herself or someone else or if Client makes threats of imminent violence against another person, Consultant will take appropriate action. These situations rarely occur, and the Consultant will make every effort to discuss the breach of confidentiality with you before taking action.

The Client understands that it is impossible to fully protect the confidentiality of information that is transmitted electronically or in telephone calls. This is particularly true of e-mail and information stored on computers that are connected to the internet which do not utilize encryption and/or other forms of security protection. The Consultant will do everything possible to protect against any unwanted intrusions, and recommends that the Client use a personally-owned computer to best maintain privacy.

Disclosure to Staff

The Consultant employs administrative staff, with whom confidential information will be shared for administrative purposes, such as scheduling, billing and quality assurance. All staff members have agreed not to release any information outside of the consulting relationship without prior written consent.

INTERACTIVE FEATURES

This Site may include a variety of features, such as bulletin boards, web logs, chat rooms, and email services, which allow feedback to us and real-time interaction between users, and other features which allow users to communicate with others. TERMINATION

We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the part of the Site affected by such cancellation or termination. The restrictions imposed on you with respect to material downloaded from the Site, and the disclaimers and limitations of liabilities set forth in these Terms of Service, shall survive.

REFUND AND CANCELLATION POLICY

Your purchase of a product or service or ticket to an event does not provide for any refund. No refunds of past payments are given.

We reserve the right to charge processing fees in the event of refunds, cancellations and other services.

  2. RECONFIRMATION – Reconfirm the use and time of flights at least 24 hours for domestic and 72 hours for international. Failure to use any reservations may result in automatic cancellation of all continuing and return reservations.
  3. From this point forward I understand and agree that monitoring International and Domestic flights will be my own responsibility, making use of the booking codes and websites I have been provided with. I understand and agree that I will have to notify either Carlos Melia or the supplier, of any cancelations or delays via email or phone, in order for them to amend bookings accordingly. Nor Design Your Destinations or suppliers will be held responsible for airline cancelations or delays. Both parties will do their best to assist with rebooting your services and offer the available options. Cancellation fees, penalties may apply subject to each service and/or supplier.
  4. CHECK-IN – Minimum check-in for domestic flights is 90 minutes and for international flights, 2 hours. BE PREPARED TO PRESENT A GOVERNMENT ISSUED PHOTO I.D. AT TICKET COUNTER.
  5. If your plans change en-route, contact the travel agency or call the phone numbers provided on this document for assistance. Additional charges may apply. It is not necessary to purchase a new ticket if a refund is due. Please cancel your reservation prior to flight time or ticket will have no value.
  6. Times, flights, and fares are based on current tariffs that are subject to change without notice.
  7. TICKETS – Most tickets have value. Any unused flight coupons must be returned in order to determine refund value. Lost, stolen or destroyed tickets must be paid for until refund is received from the issuing carrier, subject to an airline imposed service charge.
  8. HOTELS are usually confirmed on a guaranteed payment basis. If you cancel or change plans, please notify your hotel(s) within the time period specified by that hotel. Rules may vary by property.
  9. Group Travel Tour/Package Prices are subject to change without notice due to currency fluctuations, tariff changes or increase in operational costs. In addition, group travel tours/packages are based on a minimum number of passengers traveling: if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers.
  10. IMPORTANT! – If you are at an airline ticket or passenger check-in counter with your confirmed ticket and find that the airline shows no reservations for you ­do not leave the counter. Check your ticket. If the status box shows “OK” for the flight in question, the airline must accommodate you on that flight, or if that is not possible, they must either find a substitute flight or pay you denied boarding compensation. If necessary ask to speak to a supervisor.
  11. Proof of identity is required for all travel – Without proper identification, or passport and necessary visas, you will not be permitted to depart. It is your responsibility to verify your necessary travel documents.
  12. WE STRONGLY RECOMMEND TRAVEL INSURANCE – There are different types of medical, baggage or trip cancellations insurance from the supplier or the agencies. Note: Insurance coverage may not cover pre-existing conditions and may have other restrictions and exclusions. Consult the insurance carriers direct for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage.

What you should know about the possibility of airline bankruptcies:

Hopefully, there won’t be any more airline bankruptcies, but it has to be recognized that they might occur. Know how they might affect you.

  1. If an airline declares bankruptcy, it is not obligated to carry you or to refund tickets issued before the bankruptcy. Travel agents are not allowed to refund tickets on airlines which have declared bankruptcy. Money given to a travel agent immediately becomes to property of the airlines, and we are required by laws to comply with airlines’ orders.
  2. If an airline declares bankruptcy, it might continue service, limit service, or stop completely. Other airlines might accept passengers under limited circumstances or may refuse to accept any passengers from the defaulted carrier. Meanwhile, there are fine travel insurance plans available for passengers to protect themselves in case of airline bankruptcies.

GOVERNING LAW; VENUE; MEDIATION

This Agreement shall be construed in accordance with, and governed by, the laws of the State of Colorado as applied to contracts that are executed and performed entirely in Colorado. The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be Colorado. The parties agree to attempt to resolve any dispute, claim or controversy arising out of or relating to this Agreement by mediation, which shall be conducted under the then current mediation procedures of The CPR Institute for Conflict Prevention & Resolution or any other procedure upon which the parties may agree. The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration or other dispute resolution procedures.

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

SEVERABILITY

If any term, provision, covenant, or condition of this Agreement is held by an arbitrator or court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.

ASSIGNMENT

These Terms of Service bind and inure to the benefit of the parties’ successors and assigns. These Terms of Service are not assignable, delegable or otherwise transferable by you. Any transfer, assignment or delegation by you is invalid.

ENTIRE AGREEMENT; WAIVER; HEADINGS

This Agreement constitutes the entire agreement between you and Design Your Destinations LLC pertaining to the Site and Service and supersedes all prior and contemporaneous agreements, representations, and understandings between us. No waiver of any of the provisions of this Agreement by Design Your Destinations LLC shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by Design Your Destinations LLC. The subject headings of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.
